Publisher

Gribouille is a service published by Smalt Studio inc., a corporation incorporated in Québec (Canada), based in Montréal (Québec), Canada. Contact: contact@smaltstudio.com.

Site manager and person in charge of the protection of personal information: the president of Smalt Studio inc., reachable at contact@smaltstudio.com.

Hosting

The application is hosted by Render Services, Inc. (San Francisco, United States).

Organizer accounts and event data are hosted by Supabase, Inc., on Amazon Web Services infrastructure in Ireland (European Union).

Intellectual property

The website, the application, the Gribouille and Smalt logos, the templates, the colouring sheets and the illustrations provided are the property of Smalt Studio inc. and may not be reproduced without permission.

Drawings created during an event belong to the organizer and the participants. Unless the organizer explicitly refuses, Smalt may use screenshots of these creations for demonstration or portfolio purposes.

Privacy and data

Participant data

Taking part requires no account and no email. Each phone receives a random technical identifier, created on the device and not linked to any identity, used only to link drawings to their author during the event.

Participants may, if they wish, enter a first name (Colouring mode), shown with their drawing on the shared screen. This first name is automatically deleted 6 months after it was entered; the drawing is kept without the first name.

Colouring mode: the photo of the paper sheet is used only to extract the colouring, which is then shown on screen. Graf mode: the phone camera is used only to aim at the screen; no camera image is recorded or transmitted.

As with any online service, the IP address of devices is processed technically to establish the connection and limit abuse; it is not used to identify participants.

Organizer data

Creating an organizer account requires an email and a password (stored encrypted). The information entered to prepare an event (name, dates, venue, number of guests, client contact details) is used only to provide the service and prepare quotes.

Requests sent through the contact form (name, email, company, message) are used to answer them and to follow up on the business relationship.

Online payments are processed by Stripe: Smalt neither receives nor stores card numbers.

Drawings, report and clips

An event's drawings, settings and report are kept for the organizer as long as their account exists, so they can find and download them.

The organizer can create a share link for the report: anyone with this link can view the report and the drawings. They can also record short video clips of the screen for their archives.

Moderation by artificial intelligence

When the AI moderation option is enabled, drawings are sent, without any identifying data, to an artificial intelligence provider (Anthropic or OpenAI, in the United States) to check that they are appropriate. These providers do not use these images to train their models. The result of the analysis is kept with the event.

Service providers and transfers outside Québec

Smalt uses service providers to deliver the service: Render (application hosting, United States), Supabase (database, Ireland), Stripe (payment), Resend (email delivery), Anthropic or OpenAI (AI moderation, if the option is enabled), Google Fonts (typefaces) and, if you accept it, Google Analytics (audience measurement of public pages).

Some information may therefore be disclosed outside Québec and Canada. Smalt ensures that these providers offer adequate protection of personal information, in accordance with Law 25 and the GDPR.

Retention and deletion

The organizer may at any time request the deletion of an event and all its drawings at contact@smaltstudio.com. When an account is closed, its events are deleted within 30 days.

Your rights (GDPR, Law 25 and PIPEDA)

This service is intended for clients located in Québec, Canada and France. It therefore complies with Law 25 (Act respecting the protection of personal information in the private sector), PIPEDA and the General Data Protection Regulation (GDPR).

You have the right to access, rectify, erase, restrict, port and object. Any request is handled within 30 days at most, sent to contact@smaltstudio.com. You may also contact the Commission d’accès à l’information du Québec or, in France, the CNIL.

In the event of a confidentiality incident presenting a risk of serious injury, Smalt notifies the persons concerned and the competent authorities, as required by law.

Cookies and local storage

Two cookies are strictly necessary: a session cookie, to sign in to an organizer account, and a cookie that remembers the chosen language. The browser also keeps a few preferences (light or dark theme, the phone’s technical identifier, your cookie choice).

Audience measurement: only if you accept it in the banner, the public pages of the site (home, information pages) use Google Analytics to count visits and see where they come from. These cookies are never set in the organizer area or on guests’ phones during an event. You can change your mind at any time with the « Manage cookies » link at the bottom of the page. No advertising cookies are used. In addition, an internal counter, with no cookies and no data about the person, only records the number of page views per day and the site the visit came from.

Minors

Some events (weddings, family events) may welcome minors. No information is requested from participants, apart from an optional first name in Colouring mode. The organizer remains responsible for moderating the content displayed and, outside Québec, for complying with local rules on parental consent.

Terms of use

Pass and test mode

Opening an event to the public requires an active pass (Event Pass or Event Pass +, validated by Smalt, or Discovery Pass offered by Smalt). A pass is attached to a single event and is valid only for the dates, audience, modes and options stated on it.

Without an active pass, the organizer account lets you prepare the event and try it in test mode, with a limited number of phones.

It is forbidden to circumvent or attempt to circumvent the limits of a pass or of the platform (modifying the application, pages, requests or connections, reusing one event for several gatherings, sharing or reselling access, automating connections, use of the remote link by an unauthorised third party).

Smalt measures platform usage per account (time events are open, number of connected participants, moderation analyses) to ensure the service runs properly, control its costs and check that passes are respected. These measurements contain no data identifying participants.

In case of clearly abusive use or use outside a pass, Smalt may suspend the event or account concerned after informing the organizer, and invoice the observed usage at the current rate, without prejudice to any other remedy.

Content and moderation

The organizer is responsible for the content displayed during their event and undertakes to moderate the drawings or have them moderated. AI moderation, when included, is an aid and does not guarantee the absence of inappropriate content.

Professional service, available internationally

Gribouille is a Canadian online service reserved for professionals (companies, agencies, organisations) acting in the course of their business. It is not intended to be purchased by consumers.

The service can be accessed from countries other than Canada. A client using it outside Québec is responsible for complying with the laws applicable where the event takes place, in particular regarding participants' data protection, image rights, informing participants and parental consent for minors. Smalt Studio inc. acts as a technical provider on the client's behalf.

Prices are in Canadian dollars, before taxes, unless otherwise stated on the offer. Smalt Studio inc. may refuse or stop providing the service in a country where it would be prohibited or subject to sanctions.

Liability

The service is provided on a best-effort basis, with no guarantee of continuous availability, unless otherwise agreed in writing.

Display equipment (screen, projector, cabling, internet connection at the event venue) remains the sole responsibility of the client.

In the event of a proven malfunction specific to the Gribouille platform during an event, Smalt commits to refunding the amount actually paid by the client for the service concerned.

This commitment does not apply to problems resulting from a cause external to the platform: faulty or poorly connected display equipment (screen, cable, projector), unstable or insufficient internet connection at the event venue, or any other on-site condition not provided by Smalt.

Except in the case of gross or intentional fault by Smalt, this refund is the client's sole remedy and Smalt's liability cap, for all damages combined, including indirect damages (loss of business, damage to reputation, etc.), which are excluded.

This limitation does not apply to bodily injury or death, nor where the law applicable in France or Quebec expressly prohibits it.

Governing law

This site and the Gribouille services are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, excluding conflict-of-laws rules. Any dispute falls under the exclusive jurisdiction of the courts of the judicial district of Montréal. The French version hereof prevails.

This designation applies subject to the mandatory public-order provisions that a client acting as a consumer resident in France may benefit from and cannot contractually waive.
